The information is provided by Avion Palms Homeowners' Association (herein referred to as APHA), and while we endeavor to keep the information up to date and correct, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the website or the information, products, services, or related graphics contained on the website for any purpose.  Any reliance you place on such information is therefore strictly at your own risk.

In no event will we be liable for any loss or damage including without limitation, indirect or consequential loss or damage, in connection with the use of this website. Nothing on this website constitutes, or is meant to constitute, advice of any kind.  If you require advice in relation to any legal or financial matter, you should consult an appropriate professional.

Through this website you are able to link to other websites which are not under the control of APHA.  We have no control over the nature, content and availability of those sites.  The inclusion of any links does not necessarily imply a recommendation or endorse the views expressed within them.

Rental/Lease Agreements

Avion Palms Homeowners' Association is not responsible for any rental/lease agreement made between the lot owner and renter/lessee.  The renter/lessee is responsible for abiding by the association's governing documents (APHA Rules & Regulations, By-Laws and Declarations).  The following statements are key points from the governing documents.  More detailed information may be obtained from APHA Documents page.

  1. At least one member of the rental party MUST be 55 years of age or older.
  2. Pets of a non-vicious nature and weighing 30 pounds or less are welcome in the park.
    • A dog or cat pet must be on a sturdy leash when outside of your lodging.
    • No doghouses, pens or other structures intended to house pets shall be permitted.
    • You must clean up after your pet.
    • A certificate of proof of current rabies vaccination must be filed with the office.
  3. Prior to placing items in the storage area, approval must be obtained from the office.
  4. Upon arrival, renters are required to register at the office. You will receive a copy of the AVION PALMS RENTERS BOOKLET; a calendar of park activities; and a park directory.  At that time you will need to complete a Renter_Info form which includes contact names and phone numbers we could use in case of an emergency.

Lot Sales (With and Without Units)

Avion Palms Homeowners' Association is not responsible for any agreement made between the seller (lot owner) and buyer of any lot and/or unit (5th wheel, motor home, park model/trailer).  According to Florida Statutes Section 720.401, the lot owner/seller is responsible for providing the buyer with a Disclosure Statement.  The Disclosure Statement discloses the terms and conditions for being a member of APHA.   The following statements are key points taken from APHA's By-Laws pertaining to membership transfer:

  1. When an owner disposes of his lot through sale or otherwise, the owner shall:
    • Notify the Association Secretary verbally or in writing of the written agreement to sell the lot along with the new owner's name..
    • Provide the new owner with copies of the Declarations, By-Laws, & Rules and Regulations, as well as the keys to the recreation hall, maintenance building and postal box.
  2. The new member shall provide the APHA Office with:
    • A completed Owner Info form which includes contact names and phone numbers we could use in case of an emergency.
    • A copy of the signed, witnessed and notarized deed which has been filed with the Hardee County Recorder's Office and reflects the new ownership.
    • A signed and dated DISCLOSURE SUMMARY, stating that they have read the Declarations, By-Laws and Rules & Regulations and will abide by them.
    • A signed and dated "Owner Consent Electronic Transmission" (optional) - If the new owner has an email address and would like to receive electronic notification of APHA meetings and meeting minutes, the APHA must have a consent form on file.
